Engineers Terms and Conditions of use:

Findyourengineer.co.uk is owned, operated, controlled and made available by Find Your Engineer Ltd (Company no 06581454) whose registered office is Unit 4 Amber Business Centre, Rawmarsh Road, Rotherham, South Yorkshire, S60 1RU.

1. Conditions of use
By accessing or using any part of the website, www.findyourengineer.co.uk, (“the Website”) or submitting a form to subscribe to our Service you agree to be bound by the following conditions of use. If you do not wish to be bound by these conditions, you may not access or use the Website.

2. Copyright, trademarks and database rights
We own all intellectual property rights in and to the Website including the database, design, text, graphics and the software used therein and you agree not to use or copy the same or any part thereof without our consent. In particular, you acknowledge that we own all rights.

3. Our Disclaimer

We advertise and promote businesses through the Website in specified categories of Engineering in specified geographical areas “our Service.” 

  1. We reserve the right to reject, remove and/or amend advertisements text graphics or other material submitted for inclusion on the Website which in our opinion is obscene, defamatory, infringes the copyright or other rights of any third party, or which is illegal or does not meet our standards.

  2. We do not make any representation or endorsement of the creditworthiness or value of any visitor to the Website who contacts you as a result of your entry on the Website.

  3. We do not accept liability for any transactions which take place between you and visitors to the Website nor do we accept any responsibility or liability for any loss suffered by you or by any of your customers or any other person arising out of your entry on the Website.

  4. We do not accept any liability for any feedback posted on the Website from people who engage you through the Website.

  5. You agree to indemnify us for any loss we suffer as a result of any action brought against us as a result of your entry on the Website, the material contained therein or any service or product supplied by you.

  6. You are to use the information provided by find your engineer on potential customers only once and you agree not to send them information regarding advertising and marketing, unless you have been given permission to do so by the finder.

4. Engineers Member Conditions

  1. By submitting your registration form, you agree that the information you provide to us on registration for our Service is full and accurate and not misleading or untrue in any way.

  2. It is your responsibility to update us and your profile of any changes to that information by email.

  3. Each registration for our Service is for a single user only. On registration, you will be allocated a user name and password. You are responsible for all use of our Service using your registration login details and for preventing unauthorised use of your login details.

  4. Following the acceptance of your application for subscription to our Service by us, your registration form will be confirmed on the Website and make our Service available to you. It is your responsibility to make sure the information is accurate.

  5. It is your responsibility at all times to hold valid public liability insurance cover, up to date membership of applicable trade bodies and such qualifications as required by law.

5. Fees

  1. The fee for your subscription to the Website “Membership Fee” is calculated and payable annually on the anniversary of the start of your Subscription (unless otherwise stated) in advance. We shall be under no obligation to provide our Service until the Membership Fee has been paid.

  3. SMS Messages from Finders that have entered criteria that your company is a match for are charged at £1.00 (Plus VAT).

6. Our Obligations

  1. In conjunction with the Website we shall operate a text service by which potential customers can text you directly using the number you supplied. This will provide you with instant access to the potential customer’s name and number allowing you to call them back at your convenience.

  2. Text messages will be invoiced twice a month (15th and last working day of the month) and must be paid within 7 days. The invoices will be sent via email. Failure to pay will result in this feature being put on hold and could affect your entire profile contact details. Find Your Engineer accept no responsibility for the outcome of each referral. We will do out utmost to ensure you are only billed for genuine leads passed through however we cannot accept any responsibility for the content of texts received.

  3. We both agree that it is in our mutual interest that the name and brand of “Find Your Engineer”, and thus the members/advertisers of Find Your Engineer are both recognised and respected in the public eye. You also agree that it is in your interest for us to be able to remove from the Website and name any trader who is undesirable, dishonest, unreliable, not qualified or otherwise brings the good name of Find Your Engineer and its members into disrepute or harms or impedes the development of our business.

7. Feedback

  1. We will be reviewing and looking for feedback and references from people who contact you through the Website.

  2. If we receive a feedback questionnaire from a finder with a less than satisfactory rating, we will contact the Finder directly and find out the reason. If we receive more than 3 unsatisfactory ratings we may cancel your membership and end your registration with the Website and use of our Service immediately without any liability to you.

  3. If a finder submits a feedback questionnaire about you with a very poor rating we reserve the right to immediately remove your details from and end your registration with the Website and use of our Service immediately without any liability to you.

  4. We reserve the right to call any finder who has submitted a questionnaire to confirm the authenticity of their feedback.

  5. Any false feedback which is found will be removed immediately. If we find more than 3 false feedback ratings we reserve the right to immediately remove your details from and end your registration with the Website and use of our Service immediately without any liability to you.

8. Warranties

  1. We warrant that we will use all reasonable skill and care in making our Service and the Website available to you and in ensuring its availability during your Subscription.

  2. Because of the nature of the Internet, errors and omissions do occur and we do not give any other warranties in respect of our Service and the Website. In particular, you should not take the accuracy of the information for granted and we make no warranty that the Website is free from infection by viruses or anything else that has contaminating or destructive properties. All implied warranties are excluded from this agreement to the extent that they may be excluded as a matter of law.

9. Limitation of Liability

  1. We will use our reasonable endeavors to remedy faults in our Service and the Website. If we are in breach of these terms and conditions, you agree that your only recovery for damages that you incur, and your exclusive remedy, shall be limited to an amount equivalent to the Membership Fee paid or payable in relation to your use for the relevant year of our Service.

  2. We will not be liable for any business losses such as lost data, lost profits or business interruption arising from your use or inability to use our Service and/or the Website or from any action taken (or refrained from being taken) as a result of using our Service.

  3. Notwithstanding the above provisions of this clause 9, our liability will not be limited in the case of fraud or for death or personal injury caused by our negligence.

10. Reservations

  1. We reserve the right to expand, change or revise our Service as our business grows or as conditions provide.

  2. If any provision in these terms and conditions are deemed or found by any competent court or authority to be invalid or not binding, we agree that such provision shall be severable from the rest of these terms and conditions which shall remain fully in force.

  3. Neither you nor we shall be liable for any failure to perform our obligations hereunder, if such failure results from any act of riot, war, civil unrest, flood, earthquake or other cause beyond reasonable control (which shall not include failure caused by negligence or the financial condition of either party).

11. Privacy Policy

  1. The information that you provide about yourself to us will only be used by us in accordance with our privacy policy. Please read the privacy policy carefully and if you have any questions please email us.

12. Links

  1. Certain (hypertext) links will lead you to websites that are not under the control of findyourengineer.co.uk. When you activate any of these links, you will leave the findyourengineer.co.uk website, and we have no control over and will accept no responsibility or liability in respect of the material on any such other website. By allowing links with third party websites findyourengineer.co.uk does not intend to solicit business or offer any security to any person in any country, directly or indirectly.

13. Termination

This agreement and your access to our Service may be terminated by written notice if:-       

 1.    you are in material breach of this agreement and the breach is not remedied within the period of 14 days after written notice of the breach has been given to you;in the event of the circumstances referred to in clause 7 above. You may terminate this agreement and receive a pro-rata refund if our Service is discontinued or if we are in material breach of this agreement and the breach is not remedied within the period of 14 days after written notice of the breach has been given to us.  2.     Annual membership is based on a 12 month period. Cancellation during this 12 month period will be subject to 2 months notice period and payment. Cancellation after the 12 month period is subject to 1 month notice in writing.  We shall be under no obligation to provide the Service until the Subscription Fee has been paid.

14. General

  1. We may transfer and/or assign our rights and/or our obligations under these terms and conditions and this will not affect your rights. You may not transfer any of your rights or obligations under these terms and conditions.

  2. If you breach these terms and conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these terms.

  3. This terms and conditions, together with the Privacy policy and Link Disclaimer and any additional terms on our Service, represents the entire terms agreed between us in relation to its subject matter.

  4. These terms and conditions shall be governed by English law.

  5. We will try to solve any disagreements quickly and efficiently. If you want to take court proceedings in relation to these terms and conditions you must do so in the United Kingdom.
